If you have an employment problem, the first step is to contact the Ministry of Business, Innovation and Employment (MBIE).

The Employment Court is a specialist court that hears and decides employment disputes that could not be resolved through other methods.

The general process is:

  1. The employee and employer try to resolve the dispute themselves.
  2. If they cannot, they can apply to the Employment Relations Authority (ERA) for a decision.
  3. If either of them are unhappy with the ERA’s decision, they can challenge the decision in the Employment Court.
