Agreement to terms
Welcome to the Govt.nz app (‘App’). By using the App you agree to these Terms of Use (‘Terms’). Please read them carefully.
These Terms apply to your use of and access to the App and the data and information it contains or provides. The App is created and developed by the Public Service Commission (‘PSC’, ‘we’, ‘our’, ‘us’).
More information about the App and digital wallet is available at About the Govt.nz app. The way in which your personal information is collected, used and protected when using the App is set out in the Privacy Policy.
We may change these Terms from time to time. We will notify you of changes to the Terms by posting them on the App or in any other way we deem appropriate. Changes will be effective immediately upon such notification except if a change materially affects your rights or obligations, in which case the change will be effective 30 days after its notification. Continued use of the App after an update becomes effective constitutes your acceptance of the revised Terms.
Eligibility
You must be at least 13 years old to use the App.
Using the App, wallet and Digital Credentials
Use of app
You do not need to create an account to access and use the App. Some information and services are available without authentication.
The App also enables you to display digital forms of credentials, such as licences, IDs, permits, registrations or qualifications (‘Digital Credentials’) issued by government agencies or third parties (‘Issuing Agencies’). Digital Credentials may not be accepted everywhere.
Offline display is possible but may be limited.
Use of Digital Credentials
To use Digital Credentials, you must set up the App’s digital wallet on your device. The wallet allows you to store Digital Credentials.
The App does not issue Digital Credentials. Issuing Agencies are responsible for issuing Digital Credentials as well as managing all information used in connection with the issuance process.
Some credentials may appear automatically after they have been issued to you by the Issuing Agency, others require you to set them up and accept terms from the relevant Issuing Agency.
You control when and how your Digital Credentials are shared. The App never shares Digital Credentials without your consent.
When you present a Digital Credential, you consent to share its information with the third party viewing it (‘Requestor’).
Your use of Digital Credentials is subject to any applicable laws, and any Issuing Agency and Requestor terms or privacy policies.
Use and restrictions
Use of app
You must not:
- attempt unauthorised access to PSC or Issuing Agency systems, including the systems of suppliers to such agencies
- interfere with the operation, security or performance of the App
- use unauthorised third-party software to intercept data in or transmitted by the App (including Digital Credentials)
- use the App for unlawful, fraudulent, harmful or offensive purposes
- if you are using biometrics information to access the digital wallet:
- you must not allow anyone else to store their biometrics information on your device
- if someone else has stored their biometrics information on your device, then you must not enable or use the digital wallet.
Use of Digital Credentials
You must keep your Digital Credentials safe and not let anyone else use your Digital Credentials.
If you are a parent or guardian and want to manage how your child uses their own Digital Credentials, we suggest using the parental controls available for the relevant device.
When storing or using Digital Credentials, you are responsible for:
- knowing how a Digital Credential may be used. This information may be provided by the relevant Issuing Agency. In general, a Digital Credential will be subject to the same use rights and restrictions as the physical version of the same credential, including the use of false, misleading or expired Digital Credentials. Misuse or fraudulent use of a Digital Credential may by subject to fines or other legal consequences
- all transactions and communications carried out using your Digital Credentials
- your device, including ensuring your device is operational, has a functional screen and is sufficiently charged to use a Digital Credential
- keeping your device and digital wallet secure, including not sharing your authentication information with any other person and locking your device when it is not in use. If you allow other people to access your device using your security information, they may be able to access and use your Digital Credentials, for which you may be responsible
- checking your Digital Credentials are correct
- knowing whether a Digital Credential satisfies a legal requirement to carry or present a document
- carrying a physical credential where legally required (for example, carrying a driver licence when travelling overseas, if required)
- your internet connection and any related costs.
If your device is lost, stolen or compromised, you must notify all Issuing Agencies that have issued you a Digital Credential, and take steps to protect your Digital Credentials (for example, lock or wipe your device, re-establish your wallet).
If your Digital Credential is lost, or there is any unauthorised use, sharing, theft, possible compromise, or any other suspected loss of your control of the Digital Credential, you must notify the Issuing Agency that issued you the relevant Digital Credential.

Your content
If you submit, upload or share content through the App, you:
- retain ownership of your content
- grant us and relevant Issuing Agencies a limited licence to use and display it to the extent necessary to provide the relevant services to you.
You must not submit, unlawful, harmful, misleading content, or any content that breaches a third party’s rights.
We may remove your content that breaches these Terms or law.
If you provide us feedback, your feedback may be used freely by PSC and its suppliers and you will not have rights to any intellectual property that may be generated as a result.
Links to other services, websites and apps
The App enables you to access other applications and websites. Even though these applications and websites are accessible through the App, they are not owned and controlled by us. Any links to third party websites are provided for convenience only, and the inclusion of any link does not imply that we endorse or verify such websites. Accordingly, we are not responsible or liable for any loss or damage incurred by you as a result of your access to those applications and websites.
Your use of and access to third party applications and websites will be governed by their own terms and conditions and privacy policies. When accessing a third-party website or application, we recommend that you read their terms and conditions and privacy policy.
Updates, availability and support
PSC may update, suspend, modify, replace or cease providing the App.
The App may be unavailable during maintenance or outages.
Support is provided for the current and two previous major versions of iOS and Android.
Disclaimer
PSC will use reasonable endeavours to ensure the App and digital wallet are available for your use. However, PSC and Issuing Agencies make no warranty or representation, express or implied, as to continuity of service or universal acceptance of Digital Credentials.
Nothing in these Terms limits your rights under the Consumer Guarantees Act or Fair Trading Act .
Limitation of liability
We and each Issuing Agency disclaim and exclude all liability for any claim, loss, demand or damages of any kind whatsoever (including for negligence) arising out of or in connection with the use of either the App, a Digital Credential, or the information, content or materials included on the App or on any website we link to.
Termination
PSC may suspend, restrict or terminate your access to the App at any time if you breach these Terms, use the App in a way that is not intended, or misuse a Digital Credential.
You may stop using the App and delete it at any time.
Clauses that by their nature survive termination, including those on intellectual property, disclaimers and liability, still apply after termination of the Terms.
Governing law
These Terms are governed by New Zealand law. You submit to the non-exclusive jurisdiction of the New Zealand courts.
Third-party terms
If you get the App via the App Store or Google Play, their terms also apply. Apple and Google may enforce these terms as third-party beneficiaries.
These Terms also apply for the benefit of Issuing Agencies and may be enforced by Issuing Agencies in accordance with the Contract and Commercial Law Act .
Notifications
PSC and Issuing Agencies may deliver push notifications for surveys, reminders or updates.

Apple iOS Terms
The terms in this part apply, in addition to the Terms of Use above, if you use the App on an iOS device.
You acknowledge that: (i) Apple Pty Limited, Apple, Inc. or any of their subsidiaries or related entities (Apple) are not a party to these Terms; and (ii) we are solely responsible for the App and its content.
This licence granted to you by us is limited to a non-exclusive, non-transferable licence to use the App on any compatible Apple device that you own or control and as permitted by the Usage Rules as set out in Apple’s App Store Terms and Conditions.
You acknowledge that any maintenance and support services for the App, if any, will be provided by us and that Apple has no obligation whatsoever to furnish any such services for the App.
Notwithstanding any other term of these Terms, if the App does not comply with any applicable warranty or guarantee, you may notify Apple, and Apple will refund the purchase price you paid for the App, if any. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses incurred by you in connection with the App’s failure to comply with any warranty will be our sole responsibility.
You acknowledge that PSC, not Apple, is responsible for addressing any claims from you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
You acknowledge that in the event of any third-party claim that the App, or your possession and use of the App, infringes that third-party’s intellectual property rights, PSC, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a United States (‘U.S.’) Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the App, for example, you must not be in violation of your wireless data service agreement when using the App.
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms and, on your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms (as applicable) against you as a third-party beneficiary thereof.
